Studio42 Terms and Conditions plus Policy Notices

1. Studio42 maintains a ZERO TOLERANCE policy on spam. Period. This serves as your only warning. One complaint means action will be taken, no warning, no discussion, no negotiation.
2. If someone spams using a Studio42 address, that individual's account will be immediately terminated and invoiced $500/complaint received.
3. If an employee or contractor of Studio42 spams using a Studio42 email address, they will be immediately terminated and invoiced at the rate of $500/complaint received AND invoiced $5000 for the act of spamming.
4. If a Studio42 employee or contractor uses Studio42 services to spam, they will be immediately terminated AND invoiced $5000 for the act of spamming AND $500/complaint received.
5. If a Studio42 hosted site is spammed for, the site will be made immediately 403 Forbidden, the user's account will be terminated AND they will be invoiced $500/complaint received AND they will be invoiced $5000 for spamming. As soon as convenient, the site will be made 404 compliant.
6. If an employee or contractor of Studio42 spams a Studio42 hosted site, they will be immediately terminated and invoiced at the rate of $5000 for the URL being spammed AND $500/complaint received.
7. If an outside third party forges a Studio42 address into a spam, especially a Studio42 administrative address, then they will be immediately invoiced $5000 for the act of spamming AND $500/complaint received.
8. If an Studio42 URL is refered to in the spam, then an investigation will be immediately launched and those responsible will be invoiced $5000/ and $500/complaint received and an additional $10,000.00 for each SpamCop report received. Also, those responsible agree to pay the costs for the investigation. This includes valid and invalid URLs.
9. In the event that Studio42 must take action against a spammer, the spammer's contact information will be immediately sent to credit reporting agencies, law enforcements and to the courts for the small claims court filings. In addition, those who need to invoice the spammer will be provided with the spammer's contact information.
10. All mailed invoices are sent on a Net-30 term, either via fax or postal mail. Failure to pay on time will result in a 10% late fee to cover fees for having a collections agency deal with the matter.
11. Anyone who signs up with Studio42 or is employed or contracted by Studio42 has read and agreed to the terms stated above and understands the consequences of their actions and accepts these terms and conditions as stated. Anyone using a Studio42 address for any reason is also subject to this policy.
12. Usage of a Studio42 address in any matter constitutes a contract that the user has agreed to the above terms and conditions and takes full responsibility for the consequences of their actions and agrees to pay all penalties in a timely matter. This also extends to individuals and systems that forge Studio42 email addresses and DNS entries in their spams.

We would include something along the lines of "if you spam or are involved in spam, we would kill you if there were not laws preventing such actions".
